Does a power of attorney automatically work at every bank or financial institution?
Not necessarily. Banks, investment firms, insurance companies, and other institutions may follow different procedures for reviewing and accepting a power of attorney. One institution may approve the document quickly, while another may require identification, an agent certification, an affidavit, or additional legal review.
Before visiting, call the institution and ask which documents it requires, whether certified copies are needed, and if its legal department must review the power of attorney. Preparing these items in advance can reduce delays when bills, care expenses, or other financial matters need immediate attention.
A financial institution may provide its own authorization forms. However, according to the Consumer Financial Protection Bureau, a power of attorney that complies with applicable state law generally should be accepted. If a valid document is rejected solely because it is not on the institution’s preferred form, ask to speak with a branch manager, supervisor, or legal representative. Because power-of-attorney requirements and acceptance rules vary by state, consult a qualified elder-law or estate-planning attorney if an institution continues to refuse the document.
